Importantly, the criminal facilitation of tax evasion is now attracting the attention of the SFO acting under the Criminal Finances Act 2017, and the new strict liability corporate offence of failing to prevent the criminal facilitation of tax evasion by employees and associates of firms in the UK and overseas subsidiaries must be managed carefully.
